Live, In-Person Seminar Policies

In order to register for an Export Compliance Training Institute (ECTI) live, in-person seminar, you must read and assent and agree to the following terms. Your assent and agreement are evidenced by your registration for the seminar or event, although ECTI, at its option, may request you to reaffirm your assent and agreement pursuant to a separate document. Please print a copy of these policy terms to retain for your records.

Below are our policies concerning ECTI live, in-person seminars.

Program Format

Participants receive training materials that contain annotated copies of the slides used by the instructors. Case studies are included. Questions are welcomed throughout the presentations. Instructors will be available before and after the presentations to discuss specific questions or issues. A certificate is issued to each attendee upon completion of the seminar, and may be viewed, retrieved, printed, etc., from within ECTI’s online Academy, at academy.jmswierski.com.

Dress Code and Conduct

Dress code is business casual. Attendees are expected to arrive at the seminar on time, after each break, and to stay until the seminar is over. Video and audio recording are expressly prohibited. Unauthorized recording and distribution of materials will lead to immediate dismissal from the seminar and subject the attendee to additional legal action. All seminar participants are expected to conduct themselves with professional decorum and dignity. Sleeping, reading newspapers, listening to music, surfing the web, or engaging in other disruptive or distracting activities during class hours is unacceptable behavior. Only the registrant is permitted to attend the seminar; no children (regardless of age) or other family members who are not also registrants are allowed to attend any portion of the seminar, including, but not limited to, any meals that are included as part of the seminar program.

Registration Payment and Walk-In Policy

Payment in advance is required for all seminars, either via credit card at the time of registration, or via invoice. Please note that your registration is subject to cancellation if payment in advance is not received. In rare circumstances, ECTI may accept registrations at the door. In such event, every attempt will be made to have sufficient materials on hand, but we first will distribute materials to those who are pre-registered for the seminar.

Special Dietary Requests

A light breakfast, beverages, snacks and a lunch will be served each day of a live, in-person seminar. Special dietary requests can be accommodated. Please send your requests to jessica@jmswierski.com no later than 3 weeks before the seminar.

CLE Credits

Our seminars are approved for CLE credits in several states. Details can be found here.

Cancellation Policy

Refunds are available up to 30 days prior to the seminar date, minus a cancellation fee of $250. After this deadline, no refunds will be issued. However, a credit voucher equivalent to 80% of the paid tuition can be provided, which can be used toward any Export Compliance Training Institute offering within a 12-month period.

Please note that partial attendance does not qualify for partial refunds. Additionally, there will be no refunds or credit vouchers for missed seminars, and no seminar materials will be provided to registrants who fail to attend without cancelling their registration.

Cancellation or Modification of Seminar by ECTI

ECTI reserves the right to cancel all or a portion of a seminar due to low registration, unforeseen travel difficulties, emergency instructor unavailability, or other reasons. Instructors are subject to change depending on extenuating circumstances. ECTI reserves the right and sole discretion to modify the course materials, topics covered, and the order in which the topics will be covered.

Seminar Transfer Policy

Transfers to another equivalent seminar are allowed with no penalty up to 30 days prior to the registered seminar. Transfers are allowed after that date, but a transfer fee of 20% of paid tuition will apply.

Hotel Accommodation

The cost of accommodation is not included in the tuition. To book the hotel, please see instructions on the seminar location web page or contact us. Hotel rooms are available on a first-come/first-served basis and ECTI accepts no responsibility for participant guest room availability.

 

Assumption of the Risk and Waiver of Liability / Safety Acknowledgment Relating to COVID-19 and other Infectious Diseases

At the live, in-person seminar(s) or other live, in-person event(s) conducted or sponsored by ECTI for which you have registered and will be attending (individually, the “Event” and collectively, “Events”), we will be following strict safety and health protocols, such as mask-wearing, social distancing, frequent disinfection, and limited room capacities. Attendees must agree to comply with the CDC COVID-19 guidelines and all COVID-19 orders, rules, and guidelines of the applicable state and local governments. To attend the Event, you must accept this Assumption of the Risk and Waiver of Liability form (“Waiver”). Once you have accepted this Waiver, it will apply to all future Events. Note: This Waiver applies to all claims described in the “Release and Waiver” portion of this Waiver arising out of your participation or attendance at an Event, now or in the future and is not limited to claims relating to COVID-19 or other infectious diseases.

WAIVER OF LIABILITY AND RELEASE OF CLAIMS

For and in consideration of my attendance at the Event, I acknowledge and agree by clicking “Accept”, or by registering for the Event, or by attending the Event.

RELEASE AND WAIVER

I RELEASE, WAIVE, AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST ECTI, INC. AND ITS AFFILIATED PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I OR MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION OR ATTENDANCE AT THE EVENT.

COVID-19 AND OTHER INFECTIOUS DISEASE SAFETY; ACKNOWLEDGMENT / ASSUMPTION OF THE RISK

I acknowledge and understand the following:

  1.     Attendance and participation at the Event includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;
  2.     I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the Released Parties; and
  3.     I knowingly assume the risk of injury, harm and loss associated with the Event, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties.

MEDICAL ACKNOWLEDGMENT AND RELEASE

I acknowledge the health risks associated with attending the Event, including but not limited to transient dizziness, lightheadedness, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death. I agree that if I experience any of these or any other symptoms during the Event, I will discontinue participation immediately and seek appropriate medical attention. I RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY CLAIM WHATSOEVER WHICH ARISES OR MAY HEREAFTER ARISE ON ACCOUNT OF ANY FIRST AID, TREATMENT, OR SERVICE RENDERED IN CONNECTION WITH MY PARTICIPATION IN THE EVENT.

I recognize that my participation, involvement and/or attendance at the Event is voluntary and may result in personal injury (including death) and/or property damage. By attending, observing or participating in the Event, I acknowledge and assume all risks and dangers associated with my participation and/or attendance at the Event, and I agree that: (a) ECTI, Inc., (b) the property or site owner of the Event, and (c) all past, present and future affiliates, successors, assigns, employees, volunteers, vendors, partners, directors, and officers, of such entities, will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of my participation in, attendance at, and/or observation of the Event, regardless if any such injuries or losses are caused by the negligence of any of the Released Parties (collectively, the “Released Claims”). BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, I HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

COVID-19 SAFETY INFORMATION

While participating in the Event, “social distancing” must be practiced, and face coverings worn at all times to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, ECTI, Inc. has put in place preventative measures to reduce the spread of COVID-19. However, ECTI, Inc. cannot guarantee that its attendees, volunteers, partners, or others in attendance will not become infected with COVID-19.

In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not attend the Event. By attending the Event, I certify that I do not fall into any of the following categories:

  1.     Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath;
  2.     Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or 
  3.     Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.

DUTY TO SELF-MONITOR

I agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and, contact ECTI, Inc., if experiencing symptoms of COVID-19 within 14 days after attending the ECTI, Inc. Event.

I have had sufficient opportunity to read this entire Waiver of Liability and Release of Claims and COVID-19 Safety Acknowledgment. 

I have read and understood this Waiver, and I agree to be bound by its terms.

I understand I have given up substantial rights by accepting this Waiver freely and voluntarily without any inducement, assurance, or guarantee being made to me, and intend my acceptance to be a complete and unconditional release of all liability to the greatest extent allowed by law. I further agree that if any term or provision of this Waiver is determined to be invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Waiver or render unenforceable such term or provision in any other jurisdiction, and any court of competent jurisdiction is hereby empowered and authorized to modify this Waiver so as to effect the original intent of this Waiver and render it enforceable to the fullest scope and extent permitted by law.
